      Accommodation Booking Terms & Conditions

      The person whose name appears on the Booking agrees to take full responsibility for ensuring that all members of the party adhere to the Conditions of contract set out below.

      1. Booking Contract And Payments

      1. These are the terms and conditions on which we, Danby Registrars Limited (trading as Walcot Hall), accept bookings for our Accommodation, whether the booking is made directly with us or through an agent.
      2. Please read these terms and conditions carefully, and check that the details on your booking are complete and accurate before you submit your booking. If you think that there is a mistake or you require any changes, please contact us or our agent to discuss. Any agreed changes will be set out in writing to avoid any confusion.
      3. When you submit your booking to us or an agent, this does not mean we have accepted your booking. In order to confirm your chosen booking, you must pay a non-refundable deposit, £100.00 per apartment/cottage and £50.00 per glamping accommodation.
      4. Confirmation of Booking: Until we receive the deposit, your booking is deemed as provisional and we reserve the right to sell the date and or amend the price. Your booking is confirmed when you have made a deposit payment to us or an agent and you are sent a booking confirmation. This booking confirmation will contain the details of your booking and of payments made. If you do not receive your booking confirmation within 1 week of sending your booking to us or an agent please notify us or the agent as soon as possible. Please check your confirmation carefully and report any incorrect or incomplete information to us or our agent immediately.
      5. If we are unable to accommodate your booking request, you will be informed of this and we will not process your booking and no fee will be charged.
      6. These terms will become binding when you are issued with written confirmation of your booking at which point a contract will come into existence between you and Walcot Hall.
      7. If booking through our agent, payments must be made to the agent. If booking directly with us, payments via our website using Elavon Opayo or they can be made by BACS transfer on request – please contact us. 
      8. Your full balance payment will be due 30 days in advance of your check-in date. If your deposit was paid by card through our booking system, your information will be securely held and we reserve the right to charge your balance payment at 30 days should you not pay it manually prior.
      9. If we have not received payment within 10 days after the balance due date, then with regret we may cancel your booking and you will lose your deposit.
      10. Damage Deposit. We welcome responsible guests at Walcot Hall, who will take care of our property and its surroundings. We, therefore, reserve the right to ask for a damage deposit. Depending on the nature and the numbers included in your booking we reserve the right to request from £50-£1000. If taken, the deposit will be required with your balance payment. Failure to pay the deposit on the due date will result in the cancellation of your booking. In the event that damage occurs to the Owner’s property or to any fixtures or fittings, both inside and outside the property, the client will be responsible for reimbursement in full. Walcot Hall will provide receipts before deducting from the deposit.
      11. Payment processors used by Walcot Hall include Stripe, Elavon, Opayo and Black Star Merchant Services, MID 2101668066.
      12. The number of persons occupying the property must not exceed the maximum number agreed at the time of booking. We are happy to adapt and understand guest numbers may change, but we ask for total honesty and that any changes in numbers of guests be given in wiring to the owner in order that we can add them to the health and safety and fire safety sheets for your stay. We need to know numbers in case of an emergency. Changes to guest numbers may incur additional charges as laid out in your booking invoice.
      13. If extra guests are found to be on the property a fee of £45pp per day will be billed or deducted from your deposit.
      14. If you have any special requests (for example extra linen, cots etc), please let us know at the time of booking. There may be an additional charge.
      15. Walcot Hall welcomes dogs, at a surcharge of £5 per dog, for a maximum of two dogs per unit. All dogs must be under proper supervision and control at all times. They may not go upstairs and if wet please keep them out of reception/carpeted rooms. They may not sit on the furniture.
      16. VAT is included in your rental fee, at a current rate of 20%.
      17. VAT will be charged for any extras you may choose to take. This includes catering, corkage, extra guests, camping and any other extras you may book from Walcot Hall or any external suppliers you may choose.

      2. Private Events & Weddings Booking Contract And Payments

      1. These are the terms and conditions on which we, Danby Registrars Limited (trading as Walcot Hall), accept bookings for Weddings and Private Events, whether the booking is made directly with us or through an agent.
      2. Please read these terms and conditions carefully, and check that the details on your booking are complete and accurate before you submit your booking. If you think that there is a mistake or you require any changes, please contact us or our agent to discuss. Any agreed changes will be set out in writing to avoid any confusion.
      3. In order to confirm your chosen date, you must pay a £1000 non-refundable deposit.
      4. Confirmation of Booking: Until we receive the deposit, your booking is deemed as provisional and we reserve the right to sell the date and or amend the price. Your booking is confirmed when you have made a deposit payment to us or an agent and you are sent a confirmation. This booking confirmation will contain the details of your booking and of payments made. If you do not receive your booking confirmation within 1 week of sending your booking to us or an agent please notify us or the agent as soon as possible. Please check your confirmation carefully and report any incorrect or incomplete information to us or our agent immediately.
      5. These terms will become binding when you are issued with written confirmation, be that electronic or otherwise of your booking at which point a contract will come into existence between you and Walcot Hall.
      6. If booking through our agent, payments must be made to the agent. If booking directly with us, payments via our website using Elavon Opayo or they can be made by BACS transfer on request – please contact us. 
      7. Bookings made more than 12 months in advance of the event date, a non-refundable deposit of 25% of the entire rental amount will be required for confirmation of the booking. Payment of the deposit will be considered an acceptance of all terms & conditions. 12 months ahead of the booking a further non-refundable down payment of 50% is required. If your wedding is within 12 months then a 50% non-refundable down payment is required at the time of booking.  The final non-refundable balance of 25%  is due 12 weeks before the wedding day. You will be expected to adhere to the schedule of payments, if you fail to do so we reserve the right to cancel your booking. 
      8. If we have not received payment within 10 days after the balance due date, then with regret we may cancel your booking and you will lose your deposit.

      3. Walcot Hall Admission and Ticketed Events

      1. When you purchase a ticket on the Walcot Hall or Walcot Hall Events website you agree to the terms and conditions of sale, set out below:
      2. Once purchased, tickets cannot be exchanged, refunded or returned, and are valid on the date/time specified only.
      3. Once you have printed or received your tickets, please keep them in a safe place as we cannot accept duplicates, copies or other alternative tickets of any kind.
      4. Unlawful resale or attempted unlawful resale of a ticket is grounds for seizure or cancellation of that ticket without refund or other compensation.
      5. All prices are correct at the time of publishing. However, they are subject to change without prior notice.
      6. Visitors are reminded that for technical or operational reasons, some facilities may be removed or closed or entertainment cancelled and/or altered at any time. Walcot Hall reserves the right to change the programme of attractions and entertainment if at any time it is deemed necessary or appropriate to do so.
      7. All events will take place whatever the weather unless weather conditions pose a health and safety risk to our visitors and staff. We will make every effort to reschedule events or refund tickets should we close for reasons of health and safety.

      4. Cancellation And Amendment By You

      1. Walcot Hall may consider a request from a guest to change the dates of your booking after confirmation has been issued. The agreement will be given subject to the following conditions being met: i) the request is received within a week of the booking confirmation and ii) the client pays any previously advertised increase in accommodation hire costs.
      2. Any cancellation or amendment request must be sent to an agent or us (if to us, by email to enquiries@walcothall.com.com as soon as possible. You are also advised to confirm all changes by phone +44(0)1588 680 570. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will always try to help, we cannot guarantee that such requests will be met.
      3. In the unlikely event of cancellation on your part, we regret that all deposits are non-refundable. If your cancellation is more than 30 days before your booking date, and you have paid your balance, it will be returned to you by the same method with which the initial booking was made.
      4. We strongly recommend all bookings with us take out their own travel insurance policy. 
      5. All monies paid for a booking are non-refundable if you cancel within 30 days of your check-in date, although in some circumstances it may be possible to swap the booking to other dates. If this is agreed, the booking contract shall continue in effect save that (a) it will apply to the booking on the new dates, and (b) cancellation by you of the booking on the new dates will result in forfeiture of all monies paid for the holiday, whenever that cancellation takes place. 
      6. Alterations to your booking can only be made 20 days or more prior to the check-in date; after such time alterations may be treated as a cancellation. All alterations are subject to availability and may incur a fee at our discretion.
      7. Differences in the total amount payable resulting from agreed alterations will be refunded to you in the case of a decrease in price and paid by you in the case of increases in price.
      8. For Accommodation bookings that can not travel due to government covid restrictions; If your booking is unable to go ahead owing to Covid restrictions (either our location or your location being in a lockdown or government guidelines that prevent a group accommodation booking or group size being a restrictive factor as set out by government guidelines), then we would refund any payments less a £50 admin fee.

      10. Force majeure: a) For the purposes of this Contract, Force Majeure Event means an event beyond the reasonable control of Walcot Hall, including but not limited to: an act of nature (earthquake, fire, flood, hurricane, storm or any other natural disaster), illness or death, accident, war, terrorism, epidemic, national calamity, civil commotion, order of Government or Local Authority having jurisdiction in the matter, changes in law or foreign government policy, strikes or other industrial disputes (whether involving the workforce of Walcot Hall or any other party), failure of a utility service or transport network, act of God, breakdown of plant or machinery or default of suppliers or subcontractors. (b) Walcot Hall shall not be liable to the Customer as a result of any failure to perform its obligations under these Terms & Conditions as a result of a Force Majeure Event. (c) If the Force Majeure Event prevents Walcot Hall from providing the Venue on the agreed date, Walcot Hall shall, without limiting its other rights or remedies and without liability to the Customer, have the right to terminate this Contract immediately by giving written notice to the Customer (d) Where possible a postponement within a 12 month period will be offered (e) In the event of mutual cancellation by both parties all deposits will be surrendered. (f) Walcot Hall will not be responsible for any consequential or third party losses.

      5. Pricing

      1. We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. Once you have booked and it has been confirmed by us we will not change the price unless it is necessary because you seek to change your booking.

      6. Information And Accuracy

      1. The information and prices shown on this website may have changed by the time you come to make your booking. Although we make every possible effort to ensure the accuracy of the website information and prices at the time of display, regrettably errors do occasionally occur. You must therefore ensure you check the price and all other details of your chosen booking with us or our agent at the time of booking.

      7. Provision Of Use

      1. We will provide the accommodation to you as detailed in the booking confirmation.
      2. Check-in is from 4 pm on the first date of your booking and check-out is before 10 am on the last day of your booking.
      3. A welcome pack will be available for you. You are requested to comply with the guidance and instructions given.
      4. Walcot Hall is in a rural location and is a working farm and country estate, guests may experience some animal noise and occasionally noise from grass cutting or other farm machinery as well as other country activities and sports, including shooting.
      5. There are a number of natural hazards, such as sloping and uneven ground, trees and tree roots, wet grass, open bodies of water and other surfaces, of which you should be aware and take appropriate steps for the safety and enjoyment of your party.
      6. Please bring suitable footwear and torches. 
      7. In the unlikely event that there is an issue with our facilities:
        1. please contact us and tell us as soon as reasonably possible
        2. please give us a reasonable opportunity to fix any defect
        3. we will use every effort to fix the defect as soon as reasonably practicable

      8. Inclusions

      1. Unless otherwise stated, all accommodation bookings advertised on our website or via our agents are for the use of our accommodation on a self-catered basis and are inclusive of VAT. 
      2. All internal areas are non-smoking areas. If this rule is broken a £100 will be billed to you, or taken from your damage deposit. This includes e-cigarettes.
      3. Unnatural confetti, confetti cannons and smoke machines are forbidden on-site, as are Chinese lanterns and/or fireworks.
      4. Sparklers are permitted outside.
      5. Natural Confetti is allowed at the venue but must be biodegradable and preferably natural flower petals.
      6. A minimum charge of £250 for professional cleaning will be billed to you or taken off the damage deposit if a guest is sick or stains anywhere inside your accommodation.
      7. We reserve the right to charge your payment card, which is kept on file, for any damage caused in your accommodation that is not covered by a security deposit.
      8. The use of any illegal drugs is strictly forbidden whilst on our premises. This includes the use of nitrous-oxide canisters. Should any guest, found to be in possession or in use, of any illegal or illicit drug activity, you will be required to leave the property immediately. No refunds will be given if evidence of drug activity is found in your accommodation and your security deposit will be retained. We reserve the right to inform the relevant authorities of drug abuse. Nitrous-oxide canisters or drug paraphernalia left in the accommodation will incur a £100 disposal charge.
      9. Walcot Hall shall not be liable to the Client or third parties for any accident, damage, loss, injury, expense, inconvenience or act of god, which may be suffered, incurred, arise out of or in any way connected with the rental.
      10. Walcot Hall is located in a rural environment, we do not accept responsibility for any damage, injury or inconvenience whatsoever caused by livestock, plants, trees, wildlife or weather. We advise you to have the relevant insurance.
      11. Walcot Hall does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its staff or agents.
      12. Walcot Hall shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
      13. We are a family-friendly property and we ask that you are respectful of other guests at all times.
      14. Children aged 15 or under must be accompanied by an adult at times. During a school visit the teacher is in loco parentis. Accompanying adults are responsible for supervising the children in their care at all times.
      15. Visitors are reminded that for technical or operational reasons, some facilities may be removed or closed or entertainment cancelled and/or altered at any time. Walcot Hall reserves the right to change the programme of attractions and entertainment if at any time it is deemed necessary or appropriate to do so.
      16. In the event of a cancellation or closure, Walcot Hall accepts no responsibility for travel, accommodation and any other associated costs.
      17. Walcot Hall is an inclusive organisation, and we value and respect the diversity of our visitors, communities and our colleagues. Any behaviour towards our colleagues or other visitors which contradicts this will not be tolerated, and visitors will be asked to leave.
      18. Walcot Hall reserves the right, at its absolute discretion, to refuse entry or admission or to remove from Walcot Hall any visitor.
      19. Walcot Hall accepts no responsibility for any personal property.
      20. Photography is allowed for non-commercial private use only.
      21. Walcot Hall reserves the right to search the bag(s) of any visitor entering Walcot Hall, Garden or Grounds, or any other event being held on the Walcot Hall Estate. Failure to comply with a request for such a search may result in entry being refused.
      22. As a condition of sale, visitors to the Walcot Hall Estate consent to being photographed, filmed or sound recorded for use on TV, websites, social media, DVD, webcast, promotional materials, or other public mediums, as part of the audience, or by security CCTV.

      9. Pets 

      1. We allow up to two well-behaved dogs per unit. Dogs must be kept under control and on a lead around the Estate, without exception. Dogs must not be left unattended in our accommodation at any time. Guests must pick up dog deposits and place them in the bins provided. Failure to pick up and dispose of dog mess will result in a charge of £50. Walcot Hall does not accept liability for harm or injury caused to your dog or in any incident your dog is involved.  All dogs stay at the owners’ responsibility & liability.

      10. Insurance

      1. You are strongly recommended to take out personal travel insurance for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details and take them with you on holiday.

      11. Website

      1. We endeavour to keep our website up to date, but we make no warranties or representations of any kind about the quality, content, completeness, accuracy, reliability, adequacy, suitability or availability with respect to the website, or the information, products, services, or related graphics contained on the website for any purpose.       13. Our Liability To You

      1. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was within our reasonable contemplation at the time we entered into this contract. 
      2. We only supply the accommodation for private use and therefore, unless we have otherwise expressly agreed in advance, you will not use the accommodation for any commercial or business purpose. In any event, we shall have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity or other commercial loss.
      3. We do not exclude or limit in any way our liability for:
        1. death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
        2. fraud or fraudulent misrepresentation.
      4. We do not accept liability for loss of or damage to articles left by you in, or brought by you into, the accommodation or on our site. Nor do we accept liability for vehicles that are parked or left by you anywhere on our site.
      5. We do not accept liability for any loss, damage cost or claim which you may suffer where it arises as a consequence of your failure to comply with instructions or guidance provided by us in connection with use of our accommodation and its equipment or our across our site and its facilities.

      14. Termination

      1. Either of us shall be entitled at any time by giving written notice to the other to terminate the contract if the other shall be in material breach of the contract.
      2. We may require you to leave the accommodation and terminate your booking if in our reasonable opinion:
        1. your occupation (in terms of numbers of guests or otherwise) or use of the accommodation differs from that communicated to us or our agent at the time of booking; or 
        2. you are causing any nuisance, damage, disturbance, annoyance or inconvenience to other guests or third parties or to us and our staff. 
      3. In such circumstances, we will be under no liability to you in respect of any refund of the booking price or compensation for any costs or damage which may be incurred by you and you agree to indemnify us against any claim by any other guest or a third party as a result of any nuisance, damage, disturbance, annoyance or inconvenience you have caused.

      15. Personal Information

      How We May Use Your Personal Information

      1. We will use the personal information you provide to us to:
        1. provide the accommodation you have booked;
        2. process your payment for such accommodation; and
        3. inform you about similar services that we provide, but you may stop receiving these at any time by contacting us.
      2. We will not give your personal data to any third party other than our agent and only insofar as is necessary to manage a booking or process payment.
      3. We will process your data in accordance with the law.

      16. Governing Law And Jurisdiction
